Customers may cancel their Monthly Space Account only by submitting written notice via email to support@parkitny.com. No other forms of cancellation will be accepted—this includes verbal or written notice provided directly to garage staff. To be valid, cancellation must be received at least seven (7) business days prior to the first day of the month the customer wishes to cancel, and the account must be paid in full at the time of the request. If notice is received less than seven (7) business days before the start of the next billing cycle, the customer will be responsible for either the full monthly fee or the applicable daily rate for that month, whichever is less. Customers who have prepaid for multiple months or are participating in a promotional agreement must refer to the terms and conditions of their specific promotional agreement, which will govern cancellation eligibility and refund policies. In general, no refunds will be issued for early cancellation of prepaid or promotional plans, unless otherwise specified in the applicable agreement. If a customer breaches any of the terms and conditions of their parking agreement, the Garage reserves the right to cancel the Monthly Space Account immediately and without refund. Additionally, the Garage may cancel any Monthly Space Account at any time and without advance notice, unless the account is governed by a prepaid or promotional agreement, in which case the terms of that agreement will apply.
By executing this agreement, the undersigned hereby authorizes Parkit Management and the Garage Entity to initiate automatic recurring charges for Garage Charges on or about the 4th of each calendar month. Such authorization extends to the primary payment method on file as well as any other payment method provided or used by Customer in connection with the account.
Customer expressly acknowledges and agrees to the following:
By providing payment information and executing this agreement, Customer acknowledges that they have read, understood, and agreed to the terms of this Recurring Payment Authorization and Disclaimer.
This Monthly Parking Agreement (“Agreement”) is entered into between the undersigned customer (“Customer”) and the parking facility owner or operator (“Garage”) for the rental or license of a parking space (“Monthly Space”) at the designated facility (“Facility”). A Monthly Space may be assigned or unassigned and includes any reserved, leased, valet, or self-parking area provided by the Garage. The Monthly Space is allocated exclusively to the vehicle registered under this Agreement, and unless otherwise specified in writing, this Agreement does not guarantee a specific parking spot. The rental term for the Monthly Space operates on a calendar-month basis, beginning on the 1st and ending on the last day of each month. Only the Customer’s initial rental period may involve a prorated second month. Once payment is made, no refunds or credits will be issued for any unused portion of that month. Parking Rent, defined as the fee paid by the Customer in exchange for the Monthly Space, must always be paid in full and in advance. The Customer’s account balance must be zero by the 1st of each month. A grace period is provided through the 10th day of each month; however, if payment is not received by 11:59 p.m. on the 10th, the account will be considered delinquent retroactively as of the 1st. A late fee of $25.00 or 5% of the overdue balance, whichever is greater, will apply. In such cases, the Customer’s vehicle may be placed on HOLD and rendered inaccessible until the account is brought to a zero balance. The Garage reserves the right to limit payment for delinquent accounts to cash or bank check only. Unless specifically authorized in writing within this Agreement, all Parking Rent and related charges must be paid via cash, check, credit card, or ACH. The Garage may revoke any alternative payment methods at any time. Parking Rent is subject to change at the Garage’s discretion. Rent increases may be communicated by email or a written statement placed in or on the Customer’s vehicle. If the Customer enrolled under a promotion that disclosed future rate increases, no additional notice will be provided. If the Customer wishes to register a different vehicle under this Agreement, they must notify the Garage in writing at support@parkitny.com. A change in vehicle registration may result in an immediate rate increase. The Garage assumes no responsibility for the vehicle unless it has been turned off, the keys handed directly to Garage staff, and that handoff acknowledged. The Garage is not responsible for the loss or damage of any removable items left inside the vehicle, including but not limited to cash, electronics, or jewelry. Additionally, the Garage is not liable for minor physical damage such as nicks, dents, or scratches. Any damage claims must be reported and documented with Garage staff prior to the vehicle departing the Facility, and written confirmation must be signed by both the Customer and the Garage representative. Furthermore, the Garage assumes no responsibility for any damage to the vehicle unless the Customer inspects and verifies the vehicle’s condition upon arrival and again prior to departure from the Facility. The Customer agrees to hold the Garage harmless from any claims or losses that occur while the vehicle is not in the direct custody of Garage staff. In accordance with applicable law, the Garage’s liability for any theft, damage, or loss to the Customer’s vehicle is limited to a maximum of $25,000. The Customer also agrees to comply fully with all posted rules and regulations displayed throughout the Facility, without exception. The Customer further agrees to receive all communications from the Garage, including but not limited to billing notices, rent changes, policy updates, and service announcements, via electronic means such as email or text message. The Customer acknowledges that electronic communications satisfy any legal requirement that such communications be in writing.
